dependingonsystemconfiguration.DispatchRatemeansthecontrolsignal,expressedindollarspermegawatt-hour,calculatedandtransmittedcontinuouslyanddynamicallytodirecttheoutputlevelofallgenerationresourcesdispatchedbytheOfficeoftheInterconnectioninaccordancewiththeOfferData.MajordisasterAsdefinedbytheStaffordAct,anynaturalcatastrophe(includinganyhurricane,tornado,storm,highwater,wind-drivenwater,tidalwave,tsunami,earthquake,volcaniceruption,landslide,mudslide,snowstorm,ordrought)or,regardlessofcause,anyfire,flood,orexplosion,inanypartoftheUnitedStates,whichinthedeterminationofthePresidentcausesdamageofsufficientseverityandmagnitudetowarrantmajordisasterassistanceunderthisacttosupplementtheeffortsandavailableresourcesofStates,localgovernments,anddisasterrelieforganizationsinalleviatingthedamage,loss,hardship,orsufferingcausedthereby.PeakHoursor“PeakPeriod”meanstheperiodwiththehighestridershipduringtheentiretransitservicedayasdeterminedbythetransitoperator.Mustincludeatleastonehourduringthemorningcommutehoursandoneduringeveningcommutehours,MondaythroughFriday.EachPeakPeriodcannotbelongerthanthreehours.GeneratorPlannedOutagemeansthescheduledremovalfromservice,inwholeorinpart,ofageneratingunitforinspection,maintenanceorrepairwiththeapprovaloftheOfficeoftheInterconnectioninaccordancewiththePJMManuals.ClearanceSystemBusinessDaymeans,withrespecttotheClearanceSystem,anyday(otherthanaSaturdayorSunday)onwhichtheClearanceSystemisopenfortheacceptanceandexecutionofsettlementinstructions.ExcusedDowntimemeans:(a)MaintenanceTimeofuptotwohourspermonth;and(b)anytimetheSubscriptionServiceisnotAvailableduetocircumstancesbeyondServiceNow’scontrol,includingmodificationsoftheSubscriptionServicebyanypersonotherthanServiceNoworapersonactingatServiceNow’sdirection,aForceMajeureEvent,generalInternetoutages,failureofCustomer’sinfrastructureorconnectivity(includingdirectconnectivityandvirtualprivatenetwork(“VPN”)connectivitytotheSubscriptionService),computerandtelecommunicationsfailuresanddelays,andnetworkintrusionsordenial-of-serviceorothercriminalattacks.Prepaidwirelesscallingservicemeansatelecommunicationsservicethatprovidestherighttoutilizemobilewirelessserviceaswellasothernon-telecommunicationsservices,includingthedownloadofdigitalproductsdeliveredelectronically,contentandancillaryservices,whichmustbepaidforinadvancethatissoldinpredeterminedunitsordollarsofwhichthenumberdeclineswithuseinaknownamount.PolicyGrievanceisdefinedasadifferencebetweenthepartiesrelatingtotheinterpretation,applicationoradministrationofthisAgreement.ApolicygrievancemaybesubmittedbyeitherpartyatStep2ofthegrievanceprocedure.ApolicygrievanceshallbesignedbyaCLACRepresentativeandsubmittedtotheEmployer.ApolicygrievancesubmittedbytheEmployershallbesignedbytheEmployerorhisrepresentative.Transportationnetworkcompanydrivermeansanindividualwhosatisfiesallofthefollowing:Contacthourmeansanhouroftrainingreceivedthroughdirectinstruction.GroupGrievanceisdefinedasasinglegrievance,signedbyaStewardoraUnionRepresentativeonbehalfofagroupofemployeewhohavethesamecomplaint.SuchgrievancesmustbedealtwithatsuccessivestagesoftheGrievanceProcedurecommencingwithStep1.Thegrievorsshallbelistedonthegrievanceform.Seriousemotionaldisturbancemeansadiagnosablemental,behavioral,oremotionaldisorderaffectingaminorthatexistsorhasexistedduringthepastyearforaperiodoftimesufficienttomeetdiagnosticcriteriaspecifiedinthemostrecentDiagnosticandStatisticalManualofMentalDisorderspublishedbytheAmericanPsychiatricAssociationandapprovedbythedepartmentandthathasresultedinfunctionalimpairmentthatsubstantiallyinterfereswithorlimitstheminor'sroleorfunctioninginfamily,school,orcommunityactivities.Thefollowingdisordersareincludedonlyiftheyoccurinconjunctionwithanotherdiagnosableseriousemotionaldisturbance:911ServicemeansauniversaltelephonenumberwhichgivesthepublicdirectaccesstothePublicSafetyAnsweringPoint(“PSAP”).Basic911servicecollects911callsfromoneormorelocalexchangeswitchesthatserveageographicarea.Thecallsarethensenttothecorrectauthoritydesignatedtoreceivesuchcalls.Clockhourmeanseitherofthefollowing:SupportHoursmeansTelaruswillprovideeffortbetweenthehoursof7:00amand8:00pm,Melbournelocaltime,MondaytoFridayexcludingnationalpublicholidays.Forcedlabororservicesmeanslabororservicesthatareperformedorprovidedbyanotherpersonandareobtainedormaintainedthroughcoercion.Labormeanslaborers,mechanics,andotheremployeesbelowtherankofsupervisor,directlyemployedattheSiteoftheWorksubjecttotheManagerortheirdesignee’sauthoritytodeterminewhatemployeesofanycategoryare“requiredforExtraWork”andastotheportionoftheirtimeallottedtoExtraWork;and“costoflabor”meansthewagesactuallypaidtoandreceivedbysuchemployeesplusaproperproportionof(a)vacationallowancesandunionduesandassessmentswhichtheemployeractuallypayspursuanttocontractualobligationuponthebasisofsuchwages,and(b)taxesactuallypaidbytheemployerpursuanttolawuponthebasisofsuchwagesandworkers’compensationpremiumspaidpursuanttolaw.“Employees”asusedabovemeansonlytheemployeesofoneemployer.Occupationaldiseasemeansadiseasecontractedinthecourseofemployment,whichbyitscausesandthecharacteristicsofitsmanifestationortheconditionoftheemploymentresultsinahazardwhichdistinguishestheemploymentincharacterfromemploymentgenerally,andtheemploymentcreatesariskofcontractingthediseaseingreaterdegreeandinadifferentmannerfromthepublicingeneral.
