Ifyourpurchaseofferisaccepted,theRealEstateandBusinessBrokersAct,2002(REBBA)requiresthatthedepositbeheldintrustuntilitbecomespayable.Thisaccountistypicallywiththeseller’sbrokerage. TheRealEstateCouncilofOntario(RECO)administersaninsuranceprogram,whichincludescoverageforconsumerdeposits.Allbrokersandsalespeoplemustparticipateintheprogram.However,thecoverageisnotapplicabletodepositsgivento,orheldby,individualsorcompaniesnotregisteredwithRECO.Thisisimportanttoconsider,especiallyifyouareeveraskedtopayadepositdirectlytoaseller. Oncethedealcloses,yourdepositisappliedtowardsthehome’stotalpurchaseprice. Adownpayment,ontheotherhand,isusuallyacombinationofyourdepositandanyothermoneyyoupaytowardthepurchaseprice,whilethebalanceowingistypicallycoveredbymortgagefinancing. Onevitalfactortobeawareofisthatalender’sappraisalcanlimithowmuchtheyloanyouforaspecificproperty,despitethepriceyoumayhaveagreedtopaytheseller.Discussthiswithyoursalespersontoassessifyouwouldliketoaddafinancingclauseinyouroffer.
