Article2ThenationaldefenseoftheRepublicofChinaisaimedatutilizationofcomprehensivenationalpowertoestablishnationaldefensemilitaryforce,toassistdisasterpreventionandrescue,safeguardnationalsecurityandmaintainworldpeace. Article3ThenationaldefenseoftheRepublicofChinaisofall-outnationaldefense,involvingaffairspertainingtomilitary,civildefense,implementationofdisasterpreventionandrescue,andthoseinpolitical,society,economic,psychologicalandtechnologicaldomains,whichmaydirectlyorindirectlycontributetothenationaldefense. Article4ThenationaldefensemilitaryforceoftheRepublicofChinaconsistsofarmy,navyandairforce.Inwartime,theMinistryofNationalDefense(MND)maycallupotherlegalizedarmedunitstoparticipateintheorderofbattleafterthepermissionisgrantedbytheExecutiveYuan. Article5TheRepublicofChinaArmy,NavyandAirForce(ROCArmedForces)shallabidebytheConstitutionoftheRepublicofChina,swearallegiancetothenation,protectthepeople,andperformassigneddutiesinordertoensurenationalsecurity. Article6TheROCArmedForcesshallremainneutralfromindividual,regionalandpartyaffiliationsinaccordancewiththeAct.Activeservicemenareforbiddentoundertakethefollowingactivities:1.Assumingpositionsofferedbypoliticalparties,politicalgroupsandelectoralcandidates.2.Forcingactiveservicementojoinorhelppoliticalparties,politicalgroups,andelectoralcandidates.3.Establishingwithinmilitaryunitstopromotepartisanspheres,partyplatformsandotherpropagandaactivities.AnyviolationinthisregardissubjecttotheMND'sdispositionbylaw. Chapter2SystemandResponsibilityofNationalDefense Article7Thenationaldefenseisstructuredasfollows:1.President2.NationalSecurityCouncil3.ExecutiveYuan4.MND Article8ThePresidentshallassumethesupremecommandofarmy,navy,andairforceoftheROC,andisthecommander-in-chiefoftheROCArmedForces.HeexertsexecutiveauthorityovertheMinisterofNationalDefense,andtheChiefoftheGeneralStaff(CGS)followsthecommandoftheMinistertoleadtheROCArmedForces. Article9Inordertodecidemajordefensepoliciesandguidelinesrelatingtonationalsecurityorinresponsetourgentdefensesituations,thePresidentmayconvenetheNationalSecurityCouncil. Article10TheExecutiveYuanisresponsibleforformulationofdefensepolicies,consolidationofoverallnationalpowerandsupervisionofitssubordinateagenciestoconductrelevantdefenseaffairs. Article11TheMNDisinchargeofoverallnationaldefenseaffairs,shallwellperformitspolicy,command,andarmamentfunctions.Besides,itshallsubmitsuggestionsindefensepoliciesandformulatesmilitarystrategiesaccordingly Article12ThepositionoftheMinisterofNationalDefenseisofcivilianofficialnature,andheorsheshallassumetheauthorityovertheoverallnationaldefenseaffairs. Article13TheMNDhasunderittheGeneralStaffHeadquarters(GSH),servingasthestafforganizationofcommandsystem,andcommandmechanismofjointoperationstotheMinister.TheGSHisheadedbytheCGS,whoisinchargeofmilitaryaffairsofcommandsystem,andassumestheauthoritytocommandtheROCArmedForcesundertheorderoftheMinister. Article14Militaryaffairsregardingforcecommandareasfollows:1.Personnelmanagementandserviceoftheforces.2.Gatheringandanalysisofmilitaryintelligence.3.Planningandimplementationoftheoperationplans.4.Deploymentandtrainingoftheforces.5.Preparationandimplementionofmobilizationoftheforces.6.Formulationofmilitarydoctrineandresearchanddevelopment(R&D)ofcombatactivities.7.Allocationandutilizationofmilitarypersonnel,equipmentandsupplies.8.Planningandimplementionofcommunications,informationandelectronicwarfare.9.Implementationofpoliticalwarfare.10.Supervisionovertacticsandtechniques11.Implementationofdisasterpreventionandrescue.12.Othermilitaryaffairsrelatedtoforcescommand. Chapter3ObligationsandRightsofServicemen Article15Activeservicemenshallreceiverigorousmilitarytrainingtoobservemilitaryregulations,maintainstrictdiscipline,obeyorders,keepmilitarysecrets,andaccomplishassignedmissions. Article16Activeservicemenshallreceiveduerespectfortheirstatus;theirsalaries,insurance,compensation,welfare,award/penalty,andotherrightsshallbestipulatedbylaw. Article17Education,commission,lengthofservice,assignment,andmeritevaluationofofficersandnon-commissionedofficers(NGOs)oftheROCArmedForcesshallbestipulatedbylaw. Article18Therightsandbenefitsforactiveservicemen,theirdependents,andreservesshallbeprotectedbylaw. Article19Therightsofservicemenshallbelegallyprotectedwheninfringedbyunlawfulorunjusttreatments. Chapter4PreparednessofNationalDefense Article20TheMNDshall,inaccordancewithanoverallmilitarystrategyandlong-termdefenseplanningofmilitarypolicies,discreetlyformulatethedefensebudgettomeettheforcerestructuringobjectivesandmilitaryadministrationplans. Article21Thescaleofthenationaldefenseforceshallbedeterminedinaccordancewithnationalsecurityrequirements,andmaybefulfilledaccordingtorelatedconscriptionlaws.Inordertomaintainarobustreserveforce,reservistsshallbecalleduponinpeacetime,andreceivenecessarytrainingbylaw. Article22GovernmentagenciesundertheExecutiveYuanshallfollownationaldefensepoliciestoconsolidateeffortsoftheprivatesectortodevelopdefensetechnologyindustries.Acquisitionofweaponequipmentshallfirstlyconsiderthosebuiltdomestically.Whenitisnecessarytopursueoutsourcingchannels,theacquisitionactivitiesshallrealizetechnologytransferpolicysoastoestablishanautonomousnationaldefenseinfrastructure.TheMNDmaycooperateormutuallyentrustwithdomesticorforeign,andpublicorprivatecorporatebodiestoimplementR&D,production,maintenanceandsellingofdefensetechnologicalproducts.Inordertodevelopdefensetechnologyindustriesandtheirrelevantcorporatebodies,theMNDmayentrusttheprivatesectorwiththemanagementoftheMND'ssubordinateR&D,productionandmaintenanceinfrastructuresandtheirrelevantfacilities.Above-mentionedtwoconditionswillbestipulatedbylaw. Article23Inlinewithnationalsecurityrequirements,theExecutiveYuanmayauthorizetheestablishmentofemergentorsecretdefenseinfrastructuresorfacilities,andgovernmentalagenciesatalllevelsshallcooperatewithsuchadecision.Iftheabove-mentionedinfrastructuresorfacilitiesaffectcitizen'slivelihood,theLegislativeYuanmay,throughitsresolutions,requesttheExecutiveYuandirecttheMNDtoundertakerelevantimprovementsoralternations.Anyinfringementtocitizen'srightsshallbecompensatedbylaw. Chapter5All-outDefense Article24Inlinewithnationaldefenserequirements,thepresidentmaypromulgateemergencydecreesinaccordancewiththeConstitutiontospecifymobilizationtasks,andenforceoverallorpartialmobilization. Article25Inpeacetime,theExecutiveYuanmaydesignaterelevantagenciestoformulaterequiredquantitiesofmaterialinstorage,drawupmobilizationpreparationplansandconductmobilizationexercises.Duringsuchexercises,theExecutiveYuanmayimposerequisitionofprivateassetsandtheiroperators.Suchrequisitionshallbecompensatedaccordingtotherelevantlaws.Theabove-mentionedmobilizationpreparations,materialinstorage,exercises,requisition,andcompensationproceduresshallbestipulatedaccordinglybylaw. Article26TheExecutiveYuanshalldesignatespecifiedagenciestomanageaffairspertainingtomobilizationanditspreparations. Article27Inordertorealizeall-outdefense,safeguardthepeopleandtheirproperties,theExecutiveYuanmayestablishcivildefenseorganizationstooffercivildefensetrainingsorimplementexercisesinaccordancewiththeLaw.Suchorganizationsmayinpeacetimeparticipateindisasterpreventionormedicalactivities,andinwartimesupportmilitarymissions. Article28Inordertorealizeall-outdefense,safeguardthepeopleandtheirproperties,theExecutiveYuanmayestablishcivildefenseorganizationstooffercivildefensetrainingsorimplementexercisesinaccordancewiththeLaw.Suchorganizationsmayinpeacetimeparticipateindisasterpreventionormedicalactivities,andinwartimesupportmilitarymissions. Article29Centralandlocalgovernmentsshallpromotedefenseeducationforcitizenstoincreasetheirdefenseknowledgeandawarenesstosafeguardthenation,andaccordingtorespectiveauthoritydrawupplansactivelytoutilizehuman,material,financialandotherkindsofresourcesneededindefenseactivities Chapter6NationalDefenseReport Article30TheMNDshallperiodicallysubmittheNationalDefenseReportinordertoelaboratenationalgoals,generalinternationalsituations,militarysituations,defensepolicy,restructuringofthearmedforces,combatreadinessstatus,utilizationofdefenseresourcesandtheimplementationofall-outdefense.Ifnationaldefensepolicyencountersmajorchanges,theMNDshallsubmitthereportinduetime. Article31TheMNDshallperiodicallysubmitreportspertainingtomilitarypolicy,combatreadinessstatus,andarmamentstatus.Toincreasetheefficiencyofthedefensebudgetdeliberationprocess,theMNDshallcompileannulreportsontheChineseCommunistParty’smilitarystrength,ROCfiveyear’smilitarystrengthconstructionandadministrativeplantobesubmittedalongwithitsgeneralbudgetstatementtotheLegislativeYuan.ThereportsasreferredtointheprecedingtwoParagraphsmaybecategorizedintotwoversions,classifiedandopenones.TheMNDshall,withintenmonthsaftereachpresidentialinauguration,publiclysubmittheQuadrennialDefenseReviewtotheLegislativeYuan. Chapter7SupplementaryProvisions Article32Militarysecretsshallbedulyprotectedbylaw.Militarysecretsshallbeclassified,andtheclassificationsystemandtheperiodfordeclassificationshallberegulatedbylaw.Anypersonnelinvolvedinnationaldefenseandsecurityaffairsshallbelegallyinvestigated.ThecontentsandproceduresofsuchinvestigationshallbedecidedbytheMND. Article33Basedontheprincipleofautonomyandmutualrespect,theRepublicofChinamayestablishmilitary-to-militarycooperativerelationsorsigntreatiesoragreementswithfriendlynationstojointlymaintainworldpeace. Article34WhenfriendlynationsdispatchforcesormilitarypersonnelintheROCterritories,theirrightsandobligations,andotherrelevantmattersshallberegulatedbytreatiesoragreementsbetweenbothsides.Foreignnationals,uponapprovalgrantedbytheMNDandtheMinistryofInterior,mayserveintheRepublicofChinaArmedForces. Article35ActualdatetoimplementtheActisdecidedbytheExecutiveYuanwithinthreeyearsaftertheActispromulgated.
